EU Drafts Law to Regulate AI and Prohibit Facial Recognition Systems

The European Union has taken a significant step towards regulating artificial intelligence systems in the region by passing a draft law known as the AI Act. This legislation, while still subject to negotiation, includes a number of prohibitions and requirements for the use of AI technology. If enforced in its current form, the law will prohibit the use of real-time and remote biometric systems such as facial recognition scanning. It will also ban devices that manipulate behaviour through cognitive behavioural methods, and those that classify people based on personal characteristics or socio-economic status. AI technologies for biometric identification and law enforcement use will be considered “high risk” and must be registered in an EU database.

The proposed AI Act also covers generative AI companies like OpenAI, requiring them to disclose any content generated by artificial intelligence. These firms must ensure that their large language models cannot generate illegal content and are required to publish summaries of copyrighted data used to train their models. While still subject to negotiation, EU officials hope to finalize the details of this legislation by the end of the year.
