Hearing on FTC’s Merger Block: Satya Nadella from Microsoft and Activision CEO Listed as Witnesses

Microsoft CEO Satya Nadella and CEO of Activision Blizzard, Bobby Kotick, are among the witnesses scheduled to testify in a five-day evidentiary hearing set to commence this week regarding the Federal Trade Commission’s (FTC) attempt to prevent the completion of Microsoft’s $69 billion acquisition of Activision Blizzard, according to a court filing on Tuesday.

The FTC is seeking a preliminary injunction to halt Microsoft’s acquisition, stating that if granted, it would effectively terminate the deal. The acquisition is due to be completed by July 18, with Microsoft obligated to pay a $3 billion termination fee.

The hearing is scheduled to take place from June 22 to June 29.

The FTC argues that the acquisition would grant Microsoft’s Xbox console exclusive rights to Activision games, thereby excluding Nintendo consoles and Sony Group’s PlayStation.

While Microsoft’s bid to acquire Activision was approved by the EU in May, it was blocked earlier in April by British competition authorities.

During the hearing, Nadella will provide testimony on various aspects, including the video game industry, Microsoft Gaming’s plans and strategies, and the intended acquisition of Activision. Similar topics will be covered during his testimony on behalf of Microsoft.

Kotick’s testimony will focus on Activision’s gaming business, future plans, and strategies. Other witnesses include Sony Interactive Entertainment CEO James Ryan, Dov Zimring, the former director of product management for Alphabet’s Google gaming service Stadia, and two executives from Nvidia.

In addition, Microsoft Chief Financial Officer Amy Hood, Microsoft Gaming CEO Phil Spencer, and Microsoft Gaming CFO Tim Stuart are also scheduled to testify, along with several expert witnesses.
