Ruling by judge in appeals court paves the way for Apple to settle #batterygate class action suit

In May 2020, U.S. District Judge Edward J. Davila granted preliminary approval to a class action settlement between plaintiffs and Apple. Apple had secretly released an iOS update (10.2.1) that slowed down the CPU cores on affected iPhone models with degraded batteries, without informing or obtaining consent from device owners. Thus, the infamous “#batterygate” scandal emerged. Under the settlement, Apple agreed to pay up to $500 million to the plaintiffs.
Following the recent ruling by the 9th U.S. Circuit Court of Appeals, a judge has now removed the last hurdle blocking the disbursement of these payments. Two iPhone owners were objecting to the settlement terms and had appealed, but their appeal was denied. As a result, Apple can now proceed with making the payouts. SiliconValley.com, via AppleInsider, reports this development.
Tyson Redenbarger, the lawyer representing the iPhone owners, stated that they received a total of 3 million claims. The estimated payout per plaintiff is $65, but the final amount will depend on the actual number of valid claims. Redenbarger mentioned that some claims are still under assessment. Despite agreeing to pay between $310 million and $500 million, Apple continues to deny any wrongdoing.

If the capacity falls below 80%, I will receive a message indicating that my battery’s health is significantly degraded and that an Apple Authorized Service Provider can replace it to restore full performance and capacity.
