US Supreme Court Rejects Caltech Patents Challenged by Apple-Broadcom Partnership

The US Supreme Court has rejected a bid by Apple and Broadcom to revive their challenges to Caltech’s data-transmission patents in a patent infringement case. The university’s previous $1.1 billion jury verdict against the companies was overturned.

Apple and Broadcom appealed the lower court’s ruling, which prevented them from contesting the validity of the patents during their defense against the lawsuit brought by the California Institute of Technology. The US Court of Appeals for the Federal Circuit sided with the lower court, stating that the companies failed to raise their arguments during earlier proceedings at the US Patent and Trademark Office.

Apple and Broadcom argued that they should have been allowed to raise the patent challenges during the trial. However, the jury found the companies guilty of patent infringement, ordering Apple to pay $837.8 million and Broadcom to pay $270.2 million. The Federal Circuit disagreed with the amount of the award and sent the case back for a new trial on damages.

In 2016, Caltech filed a lawsuit against Apple and Broadcom, alleging that their devices using Broadcom Wi-Fi chips had infringed upon its data-transmission patents. Apple is a significant customer of Broadcom, accounting for approximately 20% of its revenue. The Federal Circuit also upheld the trial judge’s decision to block the companies from arguing that the patents were invalid because they could have raised these arguments during the US Patent and Trademark Office review.

President Joe Biden’s administration supported the Federal Circuit’s interpretation of the law and urged the Supreme Court to reject the case. Caltech has also filed separate lawsuits against Microsoft, Samsung Electronics, Dell Technologies, and HP, accusing them of infringing the same patents.
